Terms of Service

These Terms of Service (“Terms”) govern your use of all services provided by Lusso Risk Solutions Corporation, including its affiliates, contractors, and agents (“Company,” “we,” “us,” or “our”). By accessing our site or using our services, you agree to these Terms. If you do not agree, you must not access or use any part of our services.

1. Payment Terms

1.1 Due Upon Receipt: All invoices are due immediately unless otherwise agreed in writing.
1.2 Accepted Methods: Payments may be made via debit/credit card, ACH, or any accepted method on your invoice. Cash or checks are not accepted.
1.3 No Refunds: All payments are final. Refunds are not provided under any circumstance unless expressly agreed in writing.
1.4 No Contingency Billing: Services are billable whether or not your desired outcome is achieved.
1.5 Deposits: Deposits are non-refundable and non-transferable unless explicitly stated otherwise.

2. Chargebacks and Disputes

2.1 Prohibited Chargebacks: Initiating a chargeback without giving us notice and an opportunity to resolve the issue is a material breach of this agreement.
2.2 Recovery Fees: If a chargeback or reversal is initiated, the client agrees to pay:

  • The full original invoice amount

  • A $150 administrative fee

  • All legal and collection costs, including attorney’s fees

3. Service Scope & Delivery

3.1 Service Description: We provide eviction support, risk assessments, field services, legal processing, and case management as described on our website or in your service agreement.
3.2 Changes to Scope: All modifications must be confirmed in writing. Additional charges may apply.
3.3 Cancellation: At least 48 hours’ notice is required to cancel without penalty. A $75 fee applies for cancellations within 48 hours of the scheduled service.
3.4 Client Responsibility: You are responsible for making your property available, responding to communication, and facilitating service access. Missed appointments may result in forfeiture of fees.

4. Late Payments & Collections

4.1 Late Fees: Payments not made within 3 calendar days will incur a late fee of $35 or 2% of the outstanding balance per month—whichever is greater.
4.2 Collections Process: Accounts unpaid for more than 15 days may be referred to collections. You will be responsible for all associated costs.

5. Accuracy and Communication

5.1 Information Accuracy: You must provide accurate and timely information. Failure to do so may delay service or result in cancellation at your expense.
5.2 Electronic Communication Consent: You consent to receive all documentation, notices, and updates via email or other digital means.

6. Legal Terms

6.1 Jurisdiction: This agreement is governed by Georgia law. Any disputes must be brought exclusively in Fulton County, Georgia.
6.2 Indemnity: You agree to indemnify and hold harmless Lusso Risk Solutions Corporation from all claims arising out of your use or misuse of our services.
6.3 Severability: If any part of these Terms is found unenforceable, the rest remains valid.

7. Changes to Terms

We reserve the right to change these Terms at any time. Continued use of our services after such changes will constitute your consent to the new Terms.

  • Send updates and service communications

  • Maintain records and comply with legal obligations

3. Sharing Your Data

We do not sell or rent your personal data. We may share it only with:

  • Vendors directly involved in your case

  • Legal entities if required by law

  • Payment processors for transaction handling

4. Data Retention & Security

We retain records for at least 7 years or as required by law. We use secure encryption, firewalls, and limited internal access to protect your data.

5. Your Rights

You have the right to request:

  • Access to your personal data

  • Corrections to incorrect or outdated information

  • Deletion of your records unless required for legal compliance

Refund Policy

Lusso Risk Solutions Corporation has a strict no-refund policy.

  • All payments, deposits, and fees are non-refundable.

  • Refunds will not be issued for missed appointments, partial performance, or third-party delays.

  • Refund exceptions may be granted only in writing at our sole discretion.

We do not offer prorated refunds, partial credits, or service cancellations once performance has commenced. All purchases are final.
